These Terms of Use (“Terms”) apply to your access to and use of the Blazestack website located at blazestack.com and any related landing pages (collectively, the “Site”).
The Site is operated by Blazestack, Inc. (“Blazestack”, “we”, “us”, or “our”). By using the Site you represent that you are an adult of 18 or more years of age, have the legal capacity to enter a contract, and agree to comply with and be bound by these following Terms.
These Terms apply only to the Site .
Use of the Blazestack application, software platform, and related services is governed separately by the Order Form(s), Master Service Agreement, and Data Processing Addendum (DPA).
By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, you are not authorized to use the Site
1. Use of the Site
Blazestack grants you a limited, revocable, non-exclusive, license to use the Site solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You may use the Site only for lawful purposes and in accordance with these Terms.
You may not:
- Access or use the Site or any Site content in any unlawful or harmful manner;
- Attempt to interfere with the Site’s operation or security;
- Use automated tools (scrapers, crawlers, bots) without permission;
- Copy, reproduce, reverse engineer, or distribute Site content or otherwise hack into the Site without authorization
- Misrepresent your identity or submit false information through Site forms
Blazestack may suspend or restrict access to the Site at any time.You agree to comply with all applicable laws regarding your use of the Site. You further agree that information provided by you is truthful and accurate to the best of your knowledge.
2. Intellectual Property
All content on the Site—including, without limitation, text, images, graphics, logos, videos, software, and design—is and shall continue to be owned by Blazestack or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, modify, publish, or distribute any content from the Site without prior written permission from Blazestack. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of the Site
“Blazestack” and associated marks are trademarks of Blazestack, Inc.
3. Third-Party Links
The Site may contain links to third-party websites or resources. These Terms may not apply to those other websites or resources, which have their own terms and policies.
Blazestack is not responsible for the content, availability, or practices of any third-party sites, and you access such third-party sites and resources at your own risk.
4. Disclaimer
The Site and all content on the Site are provided “as is” and “as available” without warranties of any kind, express or implied and may use internet services that are not under our direct control.
Blazestack does not guarantee that:
- The Site will be available at all times, error-free or uninterrupted;
- Any content is accurate, complete, or current; or
- The Site will be free from harmful components.
We reserve the right to correct errors and to cancel any orders that were placed using incorrect descriptions or pricing. Nothing on the Site should be interpreted as professional, legal, or investigative advice. Blazestack reserves the right to cease operating the Site or any of its features at any time.
5. Limitation of Liability and Disclaimer
UNDER NO CIRCUMSTANCES WILL BLAZESTACK BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR SITE USE, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.
You may have additional rights under certain laws (including consumer laws) which do not allow the exclusion of implied warranties, or the exclusion or limitation of certain damages. If these laws apply to you, the exclusions or limitations in these Terms that directly conflict with such laws may not apply to you.
THE INFORMATION ON THIS SITE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. BLAZESTACK DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL BE TO DISCONTINUE USING THE SITE.
6. Privacy
Your use of the Site is also governed by the Blazestack Marketing Website Privacy Notice, which is hereby incorporated into these Terms and describes how we collect and use personal information on the Site. Blazestack reserves the right, and you authorize us, to use and assign all information provided by or collected from you in any manner consistent with the Blazestack Marketing Website Privacy Notice.
The privacy and security of data processed by the Blazestack software application and other services are governed by separate agreements (Master Service Agreement, DPA, and applicable agency contracts), as applicable.
7. Indemnification
You agree to indemnify, defend, and hold Blazestack and our partners, employees, and affiliates, harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or your use of the Site.
8. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflicts of law principles. Any disputes between you and Blazestack or its affiliates related to the Site must be brought in the state or federal courts located in Austin, Texas.
9. Changes to These Terms
We may update these Terms from time to time by posting modified terms to the Site. Any such modifications shall be effective immediately upon posting unless some other effective date is expressly stated. Your use of the Site shall constitute and be deemed your unconditional acceptance of these Terms.
